Hierdie voorwaardes geld wanneer jy Kleurekas (kleurekas.com) gebruik, met 'n gratis rekening of 'n betaalde lidmaatskap. Lees dit asseblief, veral die dele in vetdruk, want dit beperk ons verantwoordelikheid of plaas 'n risiko op jou.

2. Wat Kleurekas is
Kleurekas is 'n katalogus van klere by Suid-Afrikaanse ontwerpers en handelsmerke, gekoppel aan jou kleurseisoen. Ons verkoop nie die klere nie. As jy iets koop, koop jy dit by die ontwerper se eie winkel op hul eie webwerf, en hul voorwaardes, pryse, aflewering, terugsendings en terugbetalings geld. Sien ook ons vrywaring.
3. Jou rekening
- Om aan te sluit is gratis.
- Gebruik 'n korrekte e-posadres en hou jou aanmelding veilig. Laat weet ons dadelik as jy dink iemand anders gebruik jou rekening.
- Jy moet 18 jaar of ouer wees, of die toestemming van 'n ouer of voog hê, om 'n betaalde lidmaatskap te neem.
- Jy kan enige tyd vra dat ons jou rekening verwyder, by info@kleurekas.com.
4. Gratis en betaalde lidmaatskap
Die katalogus bly gratis. Die betaalde planne (Enhanced en Premium, maandeliks of jaarliks) gee jou die ekstras:
- Gestileerde uitrustings: uitrustings wat ons beeldkonsultant vir jou seisoen saamstel. Hoeveel jy per plan sien, staan op die lidmaatskapbladsy.
- My kas (slegs Premium): laai jou klere op en sien wat daarby pas, tot 'n maandelikse getal beelde. Ekstra oplaaie kan eenmalig in pakkies gekoop word; hulle verval nie, maar word nie terugbetaal sodra hulle gebruik is nie.
- Lede-afslag by vennootwinkels.
Wat elke plan insluit en wat dit kos, staan op die lidmaatskapbladsy voordat jy betaal. Jy betaal die prys wat op die lidmaatskapbladsy gewys word wanneer jy aansluit. [PLEKHOUER: of pryse BTW insluit, en of Kleurekas vir BTW geregistreer is]
5. Betaling
Betalings gaan deur PayFast. Kleurekas sien of stoor nooit jou kaartbesonderhede nie. 'n Maandelikse plan word elke maand gehef en 'n jaarlikse plan elke jaar, totdat jy kanselleer. PayFast se eie voorwaardes geld ook vir die betaling.
6. Gratis proeftydperk
Die eerste keer wat jy by 'n betaalde plan aansluit, kry jy 7 dae gratis. PayFast neem jou kaartbesonderhede met 'n eerste betaling van R0; niks word in die proeftydperk gehef nie. Tensy jy voor die einde van die proeftydperk kanselleer, word die eerste betaling op dag 8 gehef teen die prys wat op die lidmaatskapbladsy gewys is, en daarna elke maand of jaar. As jy in die proeftydperk kanselleer, betaal jy niks en hou jy die ekstras tot die proeftydperk eindig. Elke lid kry die proeftydperk net een keer.
7. Van plan verander
Jy kan enige tyd op die lidmaatskapbladsy na 'n ander plan skuif. Die nuwe plan begin en word dieselfde dag gehef, en jou ou plan stop dan. Daar is geen pro rata-terugbetaling of krediet vir die ongebruikte deel van jou ou plan nie. Dit geld ook as jy in jou gratis proeftydperk skuif: die nuwe plan word dan dieselfde dag gehef.
8. Kanselleer
Jy kan enige tyd kanselleer, sonder 'n kansellasiefooi. Jy hou die ekstras tot die einde van die tydperk waarvoor jy reeds betaal het. Lees die volle reëls, ook oor die afkoelingstydperk, in ons terugbetalings- en kansellasiebeleid.
9. Prysveranderinge
Ons mag pryse vir toekomstige tydperke verander. Ons stuur jou minstens 30 dae voor 'n prysverandering vir jou plan 'n e-pos, sodat jy kan kanselleer as jy nie wil aangaan nie.
10. Uitrustings en ons inhoud
Ons kleurseisoene, gestileerde uitrustings en stylvoorstelle is algemene leiding en ons mening, nie 'n waarborg nie. Sommige beelde in die gestileerde uitrustings word met beeldgenereringsinstrumente gemaak of geredigeer om te wys hoe stukke saam werk; die werklike klere kan anders lyk, so gaan die besonderhede by die winkel na. Kleurekas se inhoud is vir jou eie, persoonlike gebruik. Moet dit asseblief nie kopieer, outomaties aflaai (scrape) of verkoop nie.
11. My kas en wat jy oplaai
Foto's wat jy in My kas oplaai, bly joune. Jy gee ons toestemming om dit te stoor en te verwerk net om die diens aan jou te lewer. Laai net foto's op wat jy die reg het om te gebruik, en nie foto's van ander mense sonder hul toestemming nie. Jy kan jou foto's enige tyd verwyder. Hoe ons met jou persoonlike inligting werk, staan in ons privaatheidsbeleid.
12. Lede-afslag
Lede-afslag word deur die vennootwinkels self aangebied, op hul eie voorwaardes. Die afslag word by die winkel toegepas, en Kleurekas is nie deel van daardie aankoop nie. Winkels kan afslag verander of beëindig; die huidige lys is altyd op die werf.
13. Billike gebruik
Gebruik Kleurekas asseblief net vir jouself en op 'n wettige manier: moenie jou rekening deel, die werf outomaties aflaai, of probeer om dit te breek nie. Ons mag 'n rekening wat hierdie voorwaardes verbreek opskort of sluit, en ons sal jou sê hoekom waar dit redelik is. As ons 'n betaalde rekening sluit sonder dat jy iets verkeerd gedoen het, of as ons ophou om betaalde lidmaatskap aan te bied, betaal ons die ongebruikte deel van jou betaalde tydperk terug.
14. Beskikbaarheid
Ons probeer om Kleurekas altyd aan die gang te hou, maar kan nie belowe dat die werf nooit onderbreek sal word nie. Kenmerke wat as "beta" gemerk is, kan nog verander.
15. Aanspreeklikheid
Vir sover die reg dit toelaat, is Kleurekas nie aanspreeklik vir verlies wat voortspruit uit aankope by ontwerpers se winkels, uit inligting op daardie winkels, of vir indirekte of gevolglike verlies weens jou gebruik van Kleurekas nie. Niks in hierdie voorwaardes beperk jou regte onder die Wet op Verbruikersbeskerming of die Wet op Elektroniese Kommunikasie en Transaksies nie, en niks sluit ons aanspreeklikheid vir growwe nalatigheid of opsetlike wangedrag uit nie.
16. Privaatheid
Ons hanteer jou persoonlike inligting volgens die Wet op die Beskerming van Persoonlike Inligting (POPIA). Sien ons privaatheidsbeleid.
17. Klagtes
As iets nie reg is nie, kontak ons eers by info@kleurekas.com en ons probeer dit so gou moontlik regstel. As ons dit nie kan oplos nie, kan jy die Nasionale Verbruikerskommissie (thencc.org.za) of die Verbruikersgoedere- en Diensteombud (cgso.org.za) nader.
18. Rekord van jou transaksie
Jy kan hierdie voorwaardes en die terugbetalingsbeleid enige tyd hier lees, stoor of druk. PayFast stuur vir elke betaling 'n bevestiging per e-pos, en jou huidige plan en die datum tot wanneer dit betaal is, staan op die lidmaatskapbladsy.
19. Veranderinge en toepaslike reg
Ons mag hierdie voorwaardes van tyd tot tyd opdateer; die nuutste weergawe is altyd hier, met die datum hierbo. As 'n verandering betaalde lede wesenlik raak, stuur ons vooraf 'n e-pos, en jy kan kanselleer as jy nie saamstem nie. Hierdie voorwaardes word deur die reg van Suid-Afrika beheer.

These terms apply when you use Kleurekas (kleurekas.com), with a free account or a paid membership. Please read them, especially the parts in bold, because they limit our responsibility or place a risk on you.

2. What Kleurekas is
Kleurekas is a catalogue of clothes from South African designers and brands, matched to your colour season. We don't sell the clothes. When you buy something, you buy it from the designer's own shop on their own website, and their terms, prices, delivery, returns and refunds apply. See also our disclaimers.
3. Your account
- Signing up is free.
- Use a correct email address and keep your sign-in safe. Let us know straight away if you think someone else is using your account.
- You must be 18 or older, or have the permission of a parent or guardian, to take a paid membership.
- You can ask us to delete your account at any time, at info@kleurekas.com.
4. Free and paid membership
The catalogue stays free. The paid plans (Enhanced and Premium, monthly or annual) give you the extras:
- Styled looks: outfits our image consultant puts together for your season. How many you see on each plan is on the membership page.
- My closet (Premium only): upload your clothes and see what goes with them, up to a monthly number of images. Extra uploads can be bought once-off in packs; they don't expire, but are not refunded once used.
- Member discounts at partner shops.

5. Payment
Payments go through PayFast. Kleurekas never sees or stores your card details. A monthly plan is charged every month and an annual plan every year, until you cancel. PayFast's own terms also apply to the payment.
6. Free trial
The first time you join a paid plan, you get 7 days free. PayFast takes your card details with a first payment of R0; nothing is charged during the trial. Unless you cancel before the trial ends, the first payment is charged on day 8 at the price shown on the membership page, and then every month or year. If you cancel during the trial, you pay nothing and keep the extras until the trial ends. Each member gets the trial once.
7. Switching plans
You can switch to another plan at any time on the membership page. The new plan starts and is charged that same day, and your old plan stops then. There is no pro-rata refund or credit for the unused part of your old plan. This also applies if you switch during your free trial: the new plan is then charged that same day.
8. Cancelling
You can cancel at any time, with no cancellation fee. You keep the extras until the end of the period you have already paid for. Read the full rules, including the cooling-off period, in our refund and cancellation policy.
9. Price changes
We may change prices for future periods. We will email you at least 30 days before a price change for your plan takes effect, so you can cancel if you don't want to continue.
10. Looks and our content
Our colour seasons, styled looks and styling suggestions are general guidance and our opinion, not a guarantee. Some images in the styled looks are made or edited with image-generation tools to show how pieces work together; the actual clothes may look different, so check the details at the shop. Kleurekas's content is for your own, personal use. Please don't copy, scrape or resell it.
11. My closet and what you upload
Photos you upload to My closet stay yours. You give us permission to store and process them only to provide the service to you. Only upload photos you have the right to use, and not photos of other people without their permission. You can delete your photos at any time. How we handle your personal information is in our privacy policy.
12. Member discounts
Member discounts are offered by the partner shops themselves, on their own terms. The discount is applied at the shop, and Kleurekas is not part of that purchase. Shops can change or end a discount; the current list is always on the site.
13. Fair use
Please use Kleurekas only for yourself and lawfully: don't share your account, scrape the site, or try to break it. We may suspend or close an account that breaks these terms, and we will tell you why where that is reasonable. If we close a paid account without you having done anything wrong, or if we stop offering paid membership, we refund the unused part of your paid period.
14. Availability
We try to keep Kleurekas running at all times, but we can't promise the site will never be interrupted. Features marked "beta" may still change.
15. Liability
To the extent the law allows, Kleurekas is not liable for loss arising from purchases at designers' shops, from information on those shops, or for indirect or consequential loss from your use of Kleurekas. Nothing in these terms limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act, and nothing excludes our liability for gross negligence or deliberate wrongdoing.
16. Privacy
We handle your personal information under the Protection of Personal Information Act (POPIA). See our privacy policy.
17. Complaints
If something isn't right, contact us first at info@kleurekas.com and we will try to put it right as soon as possible. If we can't resolve it, you can approach the National Consumer Commission (thencc.org.za) or the Consumer Goods and Services Ombud (cgso.org.za).
18. A record of your transaction
You can read, save or print these terms and the refund policy here at any time. PayFast emails you a confirmation for each payment, and your current plan and the date it is paid up to are on the membership page.
19. Changes and governing law
We may update these terms from time to time; the latest version is always here, with the date shown above. If a change materially affects paid members, we will email you beforehand, and you can cancel if you don't agree. These terms are governed by the law of South Africa.
